Picstreak is an iOS app that helps you tidy your Photos library by swiping to keep or delete images and tracking a daily streak. It runs on-device using Apple's PhotoKit. There is no account, no login, and no server-side storage of your photos. The website picstreak.app provides information about the app.

3. Eligibility

Picstreak is rated 4+ in the App Store as a general-audience utility. To make a purchase or accept these Terms you must have the legal capacity to enter into a contract under the law of your country of residence. If you are under the age of majority where you live, you may use the app only with the involvement of a parent or legal guardian who accepts these Terms on your behalf. Apple Media Services Terms and your device's parental controls also apply.

4. Your licence

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use Picstreak on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and the Apple Standard EULA.

You may not: copy, modify, distribute, sell, sublicense, reverse-engineer, decompile, or attempt to derive the source code of Picstreak, except to the extent applicable law permits despite this restriction.

5. Subscriptions, withdrawal & conformity

How subscriptions work

Picstreak is free to download and includes the Free tier described in §2. Optional in-app purchases for Picstreak Pro unlock the additional features listed in §2. Pro is offered in three variants: an auto-renewing Monthly subscription, an auto-renewing Yearly subscription, and a one-time Lifetime purchase. In these Terms, "Lifetime" means continued access to the Pro features on the Apple ID used to make the purchase for as long as the Picstreak app remains available on the App Store and technically operable on a then-current version of iOS, subject to Apple's App Store terms; it is not a personal-lifetime guarantee and does not extend beyond the discontinuation of the app or the App Store distribution. Prices shown on our website are for the United States App Store and are provided for reference only; the binding price is the one displayed in the App Store purchase sheet at the moment of purchase, in your local currency. Prices, plans, and availability may change at any time. All purchases are sold and processed by Apple through the App Store and charged to your Apple ID. We use RevenueCat to verify your entitlement (see Privacy Policy §4).

Refunds through Apple

Apple acts as the merchant of record for App Store purchases. To request a refund for any Picstreak Pro purchase (Monthly, Yearly, or Lifetime) use reportaproblem.apple.com. We cannot directly refund App Store charges, but we can help you document a conformity issue (see below).

Right of withdrawal (EU / EEA consumers, "Derecho de desistimiento")

If you are a consumer resident in the European Union or European Economic Area, you have a 14-day right of withdrawal from a digital-content purchase under Directive 2011/83/EU and, in Spain, Articles 102–108 of Real Decreto Legislativo 1/2007 (TRLGDCU).

Important — loss of withdrawal right for immediate digital delivery. Picstreak Pro is digital content delivered instantly through the App Store. Under Article 16(m) of Directive 2011/83/EU (and Article 103(m) TRLGDCU), the right of withdrawal is lost once delivery has begun, provided that (i) you have given prior express consent to immediate performance and (ii) you have acknowledged that you thereby lose your withdrawal right. Apple's StoreKit purchase confirmation sheet, which you tap to complete the purchase, constitutes that prior express consent and acknowledgement for the purposes of this Article. If you have not used Picstreak Pro and wish to invoke any remaining withdrawal right, email support@picstreak.app within 14 days of purchase; we will record the request and ask Apple to refund you.

Conformity guarantee (EU / EEA consumers)

Independent of any refund handled by Apple, if you are a consumer resident in the EU or EEA you have a statutory right to a Picstreak Pro that is in conformity with the contract, under Directive (EU) 2019/770 and Articles 115 ff. TRLGDCU. We grant this right at the minimum scope required by mandatory law and no further; any rights, periods, or remedies beyond that minimum are expressly excluded to the extent permitted by law.

This right applies to all three Picstreak Pro variants — Monthly, Yearly, and Lifetime — on the following terms:

Consumers outside the EU/EEA have only the conformity rights granted to them by the mandatory consumer-protection laws of their country of residence, if any; nothing in this section grants additional rights beyond those mandatory provisions. Non-consumer (business) users have no conformity right under this section; see §10.

Discontinuation, App Store removal & iOS incompatibility

Picstreak is distributed exclusively through the Apple App Store and depends on Apple's App Store availability, on Apple's StoreKit and PhotoKit APIs, and on continued iOS support. The following rules apply if the app becomes unavailable or stops functioning:

5-bis. Referral programme & Promo access

From time to time we may offer a referral programme that lets you share an invite link. The same invite link (referral code) may be redeemed by multiple different people, each on their own device, for as long as the code remains valid before it expires. Subject to the rules below and to availability, both the inviter and each invitee receive 7 days of Promo access when an invite is successfully redeemed.

Campaign codes

Besides the invite links created by users, we may issue campaign codes ourselves — promotional codes with no individual inviter behind them, distributed publicly as part of a marketing campaign (for example on our website or social media). A campaign code may be redeemed by many different people, each on their own device, and is valid only for a limited time set when we create it; we may also cap the total number of redemptions, after which the code stops working even if it has not yet expired. The length of the Promo access a campaign code grants is set when we create the campaign — it need not be the 7 days a referral grants — and is stated wherever we publish the code. We may withdraw a campaign code or end a campaign early at our sole discretion, without prior notice; once a campaign code has been withdrawn, has expired, or has reached its redemption cap, it can no longer be redeemed, and no claim arises from a code you were unable to redeem in time. Campaign codes are redeemed the same way as invite links and are subject to the same one redemption per device, ever rule described below — redeeming a campaign code uses up that single redemption, and a device that has already redeemed any code cannot redeem another. What you receive is the same Promo access described in this section, with all the same characteristics: bound to the device that redeemed it, not transferable to another device, not a subscription and not a purchase.

What Promo access is (and is not)

Promo access is a free, time-limited grant that unlocks the same features available to Pro subscribers (see §2) for the duration of the grant. Promo access is not a subscription, not the Picstreak Pro product (Monthly, Yearly, or Lifetime), and not a purchase. It does not auto-renew, no payment is charged, and it does not create or extend any billing relationship with Apple or with us. When the grant period ends, you return to the Free tier unless you hold a separate paid entitlement.

7. Your photos remain yours

Picstreak does not upload, store, or take any rights in your photos. All swipe actions happen on your device. When you confirm deletion, Picstreak asks iOS to move the selected items to your Photos "Recently Deleted" album using Apple's standard PhotoKit API. iOS handles deletion; we never touch your photo files server-side.

You are responsible for maintaining backups of your photos. We strongly recommend you have an iCloud or other backup before using delete features.

Trash retention and automatic clearing

Items you move to Picstreak's in-app trash are kept for a limited window before they are queued for permanent deletion: 48 hours on Free and 7 days on Pro. The retention window is measured from when you placed each item in the trash. When that window elapses, items may be cleared automatically in the background without further confirmation. If you open the app and items in trash have already expired, Picstreak will prompt you to confirm the clean-up before asking iOS to move the underlying photos to your Photos "Recently Deleted" album. iOS then governs final deletion under its own retention rules.

8. Third-party services

Picstreak uses Apple StoreKit, RevenueCat, and Sentry. If you participate in the referral programme described in §5-bis, the Picstreak-operated Referral Service is hosted on Vercel (serverless functions) and stores data in Vercel Postgres operated by Neon (EU region). Your use of those services is also subject to their own terms and privacy policies, as described in our Privacy Policy (§4 for Apple, RevenueCat, and Sentry; §3-bis for the Referral Service and its Vercel/Neon subprocessors). Separately, the picstreak.app website uses Google Analytics for visit statistics, but only if you accept the cookie banner; details and opt-out are in Privacy Policy §4-ter. We are not responsible for the practices of third parties.

9. Disclaimers

Picstreak is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will detect every duplicate or correctly classify every photo.

You acknowledge that deleting photos is irreversible once they leave your iOS "Recently Deleted" album. You are responsible for your own backups.

10. Limitation of liability

Consumers. If you use Picstreak as a consumer, our liability towards you is governed by mandatory consumer-protection law (in Spain, the TRLGDCU and the conformity regime described in §5) and is not limited or excluded by these Terms. Nothing in this section reduces a right you have under mandatory consumer law.

Business / non-consumer users. To the maximum extent permitted by law, in no event will we, or Natalia Skoblik personally, be liable to a non-consumer user for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, photos, profits, or goodwill, arising out of or in connection with the app, even if advised of the possibility of such damages. Our total aggregate liability to a non-consumer user for any claim arising out of or relating to these Terms or the app is limited to the greater of (a) the amount you paid us (or Apple for the app) in the twelve months before the event giving rise to the claim, or (b) €50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, death or personal injury caused by negligence, or non-conformity rights under EU consumer law.

10-bis. Indemnification (business / non-consumer users)

This section applies only to non-consumer (business) users and does not apply to consumers. If you use Picstreak as a consumer, nothing in this section limits or affects your mandatory statutory rights, and you owe no indemnity under it.

If you are a non-consumer user, you agree to indemnify, defend, and hold harmless Natalia Skoblik and any person involved in operating Picstreak from and against any third-party claims, liabilities, damages, losses, and reasonable expenses (including legal fees) arising out of or connected with: (a) your breach of these Terms or of the Apple Standard EULA; (b) your misuse of the app, including use of the app to access or process content you have no right to access; or (c) your violation of any applicable law or the rights of a third party. We will notify you of any such claim, and you may not settle it in a way that imposes any obligation or admission on us without our prior written consent.

11. Termination

You can stop using Picstreak at any time by deleting the app. We may suspend or terminate access if you materially breach these Terms or use the app in a way that creates risk for us or other users.

Sections that by their nature should survive termination (e.g., §§ 5 (final conformity claims arising during the conformity period), 9, 10, 10-bis, 12-bis, 13, 13-bis) will survive.

12. Changes to the app or Terms

We may update Picstreak and these Terms over time. If we make material changes to these Terms, we'll update the "Last updated" date and notify you in the app on next launch. Continued use after changes take effect means you accept the updated Terms.

12-bis. Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including (without limitation): acts of God; war, terrorism, civil unrest, or sanctions; epidemic or pandemic; failure or unavailability of the Apple App Store, Apple developer programme, StoreKit, PhotoKit, iCloud, or any other Apple service we depend on; Apple's removal of the app, termination of our developer account, or material change to its App Store rules, fees, APIs, or distribution model; failure or unavailability of RevenueCat, Sentry, or any other third-party service used by the app; outage of internet infrastructure, hosting, DNS, or telecommunications; governmental action, regulation, court order, or change of law; cyber-attack, ransomware, or large-scale security incident; or any other event of a similar nature. During a force majeure event, our obligations are suspended for as long as the event continues. This clause does not limit any non-excludable consumer rights described in §§ 5 and 10.

13. Governing law & courts

These Terms are governed by the laws of Spain, excluding its conflict-of-laws rules.

Consumers are entitled to the protection afforded to them by mandatory provisions of the law of their country of residence. A consumer may bring proceedings against us in the courts of their country of residence, and we may bring proceedings against a consumer only in the courts of the consumer's country of residence (in line with Articles 17–19 of Regulation (EU) 1215/2012, Brussels I bis). A consumer may also choose to bring proceedings against us in Valencia, Spain.

For non-consumer (business) users, the exclusive jurisdiction is the competent courts of Valencia, Spain.

13-bis. General provisions

14. Consumer rights & dispute resolution

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer-protection law, these Terms do not affect your statutory rights, including:

Alternative dispute resolution. The European Commission's Online Dispute Resolution platform was closed on 20 July 2025 and is no longer available. If you are a consumer with an unresolved complaint, you may contact a consumer-arbitration body. In Spain the competent body is the Junta Arbitral de Consumo de la Comunitat Valenciana and the relevant municipal or regional consumer office (OMIC). Picstreak has not adhered to the Spanish consumer-arbitration system, so participation in arbitration is voluntary on our part; we will, however, engage in good-faith correspondence to resolve any consumer complaint received at support@picstreak.app.
